Tricky situation - Need Urgent Help !!

Hello All !

I have been a silent reader of this forum and since now faced with dilemma thought I'd benefit from others experiences and knowledge.

Situation :

Was on Tier 2 since Nov 2012 and in May 2013 License of my sponsor was revoked giving me 60 days to make a fresh application. Since then have found a new employer who has advertised the vacancy (labour market test) for me however 28 days will finish few days over my 60 days. Hence will not be able to apply withing the time limit.

Upon consulting lawyers, have advised me of two possible scenarios:

a) Submit a tier 4 application and when 28 days are over send in tier 2 application with a letter asking them to not consider tier 4 and just process tier 2 ( both applications will be made within 8 days).

b) Submit incomplete tier 2 application along with a letter explaining the situation and send in COS and other documents 7 days later in hope they will not refuse it.

Please help me make an informed decision as i only have a week or so left to decide

I think the first option is better as I have been in similar situation to yours.

if you take the second option, i personally feel its a proove to ukba that the rmlt test is not valid. as in how can you be sure you will get the job before the rmlt is completed.
