[PLEASE HELP] Tier 2 (General) Dependent Visa

Post by jeff0802 » Sat Jun 29, 2013 10:20 am

Hi all,

I've been looking around for the answers to my questions below and thank God I found this forum!

I'm currently on a Tier 2 General visa with a A rated sponsor (expiring March 2015), and my girlfriend is on the Tier 4 Student visa (expiring Jan 2014). We both applied via the Point base system.

We were thinking of applying for a Tier 2 Dependent visa for my girlfrd so that we can be together as her visa is expiring soon. However we were a bit confused about the whole process.

Therefore it would be great if you guys could help us to clarify the following points please?

- What sort of maintenance funds do we need to show the UKBA? Do we both need to show prove that we have enough funds in our accounts for the last 3 months, or just my bank statements would be sufficient?
- It is possible for her to transfer from Tier 4?
- Do we need to prove that we are unmarried partners? We have been living together for the last 1 year and our names are both on the contract for the flat, together with bills etc.

I've been looking at the UKBA website and other sites but the answers are somewhat mixed. Therefore we would be extremely grateful if you guys could help us out with regards to the questions below.

Many thanks!!

Jeff :)

Unfortunately 2 years cohabitation is required for an unmarried partner visa. See Immigration Rule 319C(c)(iii)

Thanks for the quick response manci. I was thinking about going to the local council and register as a married couple... Do you think it would work, or we still need to show proofs of 2 years cohabitation?

Cheers

once you are married there is no requirement to show 2 year cohabitation. However, you need to look at the regulations for migrants who wish to marry in the UK:

Also, check if the requirements for a dependant visa can be met:

Thanks a lot for clarifying Manci, you're star!

This goes back to one of the initial questions that I have though.. If we apply, does the UKBA need to see the funds in both of our accounts, or just mine would be sufficient? She is not working at the moment so her balance may fall below £600 for a couple of times over the last 3 months. If they only need to see the funds from one account (in this case, my account) then we will have no issue.

Thanks again & I'm sure someone will find this topic extremely useful in the future :D
