Advice please

Post by tim131 » Mon Jul 01, 2013 5:45 pm

Hi there,

I am an Irish citizen but living in the UK. I am married to a Mexican national - we both want to move and live in Ireland - how would we go by doing that? is it all possible, can we do it pretty soon, or will it take a long time?

Any advice would be gratefully received.

Many Thanks,

Tim

What have you been doing in the UK?

I am working. Would move back in with my parents until we find our feet. But I was born and raised in Ireland, have an Irish passport in my bedside table.

You will be able to rely on the Surinder Singh ruling, when you arrive in Ireland, you will not need to do anything in order for your husband to apply for stamp4EUFAM other than present your work activities in the UK, employment letter, payslips, rent contract, utilities bills, you should also show proofs that he has lived together with you in the UK.

The Surinder Singh ruling means you will be treated as if you are holding another EU country's passport and thus his application should be straightforward.

Your spouse can apply for an Irish visa, free of charge.

A copy of your passport, spouse original passport and an original marriage cert are needed. Then say that you (the EU citizen) are working in UK and want to move to Ireland to work.

Your spouse will get the visa fast and free. Then move to Ireland and get PPS number for spouse. Then you get a job and then your spouse applies and gets a long term residency EUFAM visa/stamp.

Simple, so long as you get a job within three months of arrival in Ireland.

If not a a visa national, then this would not be required.
