How do I calculate my 5 years of exercising treaty rights?

Post by vertigoreality » Tue Jul 02, 2013 11:54 am

Hello.
I am a Polish national. I have been working professionally in the UK since I arrived 5 and a half years ago. I did not apply for the Workers Registration Scheme until 1 year after I arrived and started working.
My question is how do I count the 5 years required for ILR? From the day I arrived and started working or from the day I received my WRS certificate? This is particularly confusing since the WRS program was shut down 2 years ago.
Any info on this would be greatly appreciated.
Thank you.

If you were worker only then Your clock towards securing PR will start from the time you registered under WRS scheme and completed the initial 12 months as worker.

So to clarify, working, which is normally considered as a way to exercise treaty rights, does not count in this case as I was an Ascension state member and unregistered under the WRS and even though the whle WRS has since folded anyway??

My original question is not related to me getting citizenship. I would like my children to get citizenship and I dont think they can get it until I have been under the WRS for 5 years based on what you are saying.

correct. You had to follow the rules as they were at the time.

Are they UK born? Then they can apply for registration when you achieve PR (5 years after WRS). If they are born abroad, they can only apply once one of the parents apply for naturalisation.
