Applying for visa during Cooling off period

Hi ,
I returned to India on 11th Aug 2012 and my visa expired on 21 Sept 2012.
I was on Intra Company Transfer(ICT) Tier 2 visa.
My cooling off period ends on 11th Aug 2013 and I need to get back to UK on 12 Aug 2013.
So can i apply for visa before my cooling off period ends so that i can get a visa issued from 12th Aug 2013 itself.

According to the Immigration Rules the date of application cannot be earlier than the end of the cooling-off period

What T2 ICT visa were you on in the UK and when did you receive your previous entry clearance?
