ILR Query - Urgent Help Needed

Hi Guys,

I have recently completed my 5 years in the UK. I have been on WP, Tier-2 (ICT) and Tier-1 through out this 5 years. Between June 2008-09, I was on WP employed at UK but on Indian payroll. I was paid daily allowance in UK during this time. There is no HMRC record of this daily allowance.

Am I still eligible for ILR considering 2008-09 employement? I have letter from employer stating I was employed in the UK and paid daily allowance. Also bank statements confirming allowance paid.

Please confirm urgently. Many thanks.

I guess it will depend on what category are you claiming ILR under. If you are applying under Tier 1 then you need to show earnings from within the last 15 months, and this should not matter.

Hi, Many thanks for your response. Yes I am applying under Tier-1. But there has been few instances mentioned on the forum where case worker has asked for P60's of five years. I have P60's for all four years except one year mentioned where I was paid daily allowance. Any thoughts considering that?
