If your baby is not a British citizen, it is quite lawful for him or her to remain in the UK without making an immigration application. There’s no need to make an application for them. However, the baby will need immigration permission to re-enter the UK after any travel abroad.
To make any immigration applications on behalf of a child, you will need to obtain a national passport for the child from the relevant embassy/consulate or issuing authority in your country.
You can only apply visa for the baby if u meet:
Both the child’s parents are in the UK OR
Both the child’s parents are applying at the same time as the child OR
One parent has sole responsibility for the child’s upbringing OR
The other parent has died
