EEA Family member 10 years based ILR

Dear All

My friend is in the uk for 10 years. He spent 8 years on student visa and then

converted to EEA family member and have this status for two years.

My query is that is he eligible for 10 years based ILR or he has to complete

further 3 years to get PR. Please help my friend in this regard.

I am going to move this to a more appropriate forum section.

For PR, he will have needed to have been living in the UK in accordance with the EEA regulations with family member for five years.

ILR under UK rules is possible after 2 years and PR is also possible after 3 years under EEA rules. But in both cases during the required period the EU national must be exercising its treaty rights. If you choose ILR then application fee will be costly with life of uk test and if you choose PR route then the application will incur very nominal fee without life of UK test.

Hi guys,

Would like to ask about my situation.

I spent 2 and half years as student visa tier 4
Plus 3 years as tier 2 skilled migrant
Last april 2013 I got my eea RC as unmarriend partner of eea national.

Question is, am I qualified to apply for ILR after 2 years of my eea visa even I'm not gonna finish the 5 years?

If yes? What route, pls help I'm so confused /:

NO. The period you spent earlier to EEA2 RC was under UK immigration rule but your present status is under EEA route and therefore, that time is not exchangeable to either of the visa statuses for the purpose of ILR/PR.

wrong how come some of the members in the forum got ILR ?

i remember a member was 6 yrs student and 4 years EU and got ILR

That is for 10 years long residence, the above poster has ony been in the UK for 5 years and thus should need anther 5 years for ilr/pr.
