child benefit

I am British and my wife is on spouse visa 27 months. I am working full time and we are expecting our first baby in Sep. Pls help if I can apply for child benefit and how,also can I apply for child tax credit. I called hm revenue and they said no because your wife is subject to immigration control, I replied child will be British and its for the child not for my wife.
Any help will be appreciated.thanks

You can claim child benefit in your name and tax credits in joint names. When you come to claim, if the HMRC say you cannot claim tell them you want it in writing - a decision. You can then appeal a decision.
