Tier 1 ILR

Hi everyone asking this question on behave of my friend who is soon applying for ILR.
he is on teir 1 and completing his 5 year in nov 2013. he has his wife and two son who lives in pakistan. they came to UK with him back in jan 2009 when he initailly got teir 1 and went back after 2 years as cannt able to settle here.

now his question is if he call his family to join him in uk, will his family be eligable to apply for ILR with him as they have spend 2 years with him already or it must be last 2 years before you apply for ILR?

To my understanding, if he has extended their respective visa's without any breaks yes, they can apply for ILR. If their visa has expired....I think they will fall under the new rules, as they may be making fresh applications.

thanks for reply . at the moment their tier 1 dependent visa has now expired. but they got their initial dependent visa before july 2012. so waht u think?
