Question related to Finnish Residence Permit - Family Ties

Post by Venusian » Thu Jul 04, 2013 1:07 pm

Greetings,

I am a citizen from a North-African country, married to a Finnish citizen. About three months ago, I applied for a residence permit on the basis of family ties, in my home country, at the Finnish embassy.

While I am still waiting for the application to be processed, I have a question about the validity of the permit should I get it.

If my application is approved, I would receive a one-year renewable residence permit. After asking the Finnish immigration office, I was told that I would need to move to Finland to live permanently with my husband for at least half the duration of the permit (so at least six months).

They were not very clear about the consequences if I were not able to move to Finland within that time frame. So I am hoping that someone here could give me more information.

What if I am not able to move to Finland within the first six months of the permit's validity (for personal reasons)? Could they refuse to renew it once the year is up, even though I would be living with my husband as a family when applying again?

Many thanks.

Where do you live presently?

Have you lived with your husband in any EU member state other than Finland?

I live in my home country, Algeria.

No, my husband and I have never lived together, not in Finland, nor anywhere else (just traveled).

We have been together for a few years, but only married for eight months (if that's of any help)

European free movement law will only apply to your move to Finland once your husband and you have lived in a different EU member state and he has worked there.

It sounds like you are doing a normal application under Finish law. But I do not know much or anything about Finish law.

Please update this as things develop. It may be helpful to somebody else in the future
