can i ask for my passport back while i am appealing.....

I have applied my entrepreneur visa in july 2012. got refused in june 2013.
I have appealed against the decision.
can I ask for passport back from the home office as I want to use them somewhere else urgently. ( I can send them them the proof of my necessity).

Hi,

As far as I know, you can only ask your passport back while your case is pending is if you have familiy emergency and if you want to leave the country. HO needs documentory evidence to prove this. You can not ask your passport back for any other reasons. If you ask that, your application will be invalid means it get refused.

Whatever be the problem or emergency with you,or whatever proof you provide to them,they will never return your passport until and unless you have spoken to the team and you have booked your ticket and provided it to the team who will give you the venue and time only at airport departure section.
Secondly if you propose to return voluntarily,they will ask you to submit first withdrawal of appeal application,then within 28days they will arrange your passport but they will get a declaration and booked flight ticket in original which will be given at airport on date of departure.
since 3months I am trying to get my passport back but failed at all.Even I contacted local MP who apologised that he couldn't do to change this rule.

Sorry to hear about your refusal premcomm , could you please sate the reason of your refusal , did they ask for more documents before this or were you invited for interview before the refusal?. To the best of my knowledge I don't think you can ask for your passport back,except you are withdrawing your application and leaving.. Hope this helps .

yes, u can ask your passport back, but I think you have to withdraw the application.
