I am polish and spouse is Nigerian. We are due PR though we wont be applying. My spouse sister is also have a residence card after several refusals.
My sister in law (will henceforth refer to as my sister) came into the UK with a depandant visa. Her husband was a student. Upon his completion of studies,he had to leave the UK,which meant my sister had to leave as well. My sister went to her country to apply to come back in as a student but was refused. Luckily for her myself and my husband were about to get married and we ask her to get us a wedding ring and attend our wedding.she did not have to apply has she somehow had visitors visa.
Upon arrival at heathrow immigration she was detained. They question her because she was recently refused a student visa. We found out later that her husband had filed divorce just because he wanted to go into a marriage of convenience. So the immigration officer wanted to find out why she came back to the UK. She was served with a deportation later and was taken to a detention camp. Fortunately,she had our wedding ring and tradition attire. So we spoke to her caseworker tbat whatever they intend to do will have to be on hold has she needed to attend our wedding because she was in possession of all the things we needed. After thourough investigation on our status,they released her. We got a lawyer involved and applied for RC has depandant on my husband *non-eu. She was refused based on lack of proof that she resided in the same country has me before moving to the UK and lack of evidence to show she was dependant on my husband.
Case was taken to judicial review and if i remembered the wording perfectly,the judge or reviewer actually said the case should not have come to court,that it was a waste of pubic fund. My sister in law was then issued a RC.
For people looking to bring extended family member here.....its hard applying for FP outside UK,get them in another way and just apply for a RC as soon as they step in and make sure you involve a lawyer.
