tier 2 ICT - tier2 general/settlement

Post by madl » Fri Jul 05, 2013 3:07 pm

Hi

I have been granted Tier 2 visas as follows

First visa from India on 10-Aug-2009 valid till 02-Mar-2010 as TIER 2 (INT COM TRAN) MIGRANT, I have entered UK on 23-AUG-2009
Extended BRP from 26-Mar-2010 valid till 14-Oct-2010 as T2 INT COM TRAN LEAVE TO REMAIN.
Extended BRP from 11-Nov-2010 valid till 14-Mar-2011 as T2 ICT EST STAFF LEAVE TO REMAIN.
Extended BRP from 21-Apr-2011 valid till 14-Aug-2011 as T2 ICT EST STAFF LEAVE TO REMAIN.
Extended BRP from 26-Aug-2011 valid till 14-Apr-2012 as T2 ICT EST STAFF LEAVE TO REMAIN.
Extended BRP from 15-Jun-2012 valid till 13-Apr-2014 as T2 ICT EST STAFF LEAVE TO REMAIN.

If I have to apply for extension after 13-Apr-2014, what is maximum length I can apply it for.
If I have been extended in Apr-2014, can I apply for settlement in Aug-2014
Am I eligible to switch to Tier 2 general and apply for settlement in Aug-2014

Thanks

If I have been extended in Apr-2014, can I apply for settlement in Aug-2014 the earliest you can apply is 28 days before 23/08/2014

Am I eligible to switch to Tier 2 general and apply for settlement in Aug-2014 yes
Thanks

I'm in a similar situation so just wondering if you can help me as well.

I'm currently on a Tier-2 ICT Established Staff visa that was issued in August 2010.

Under the new rules, will I be able to switch to a Tier-2 General visa with the same or another company?

Also, just wondering if I'll be eligible for ILR in August 2015 when I complete 5 years in the UK. Just an additional piece of information - I had a Tier-2 ICT Migrant Staff visa from Jan 2010 - Feb 2011 which was cancelled to issue my existing Tier-2 ICT visa in August 2010. However, I did not travel the original visa.

Thanks

However, I did not travel the original visa. Unfortunately you are not eligible for ILR because the notional 5 year qualifying period (which started in August 2010) did not include time before 6 Aril 2010. However, if you switch to T2G the ILR clock will start ticking and provided you comply with all requirements you will be eligible for ILR 5 years after the switch
Thanks

Great. thanks for the details.

Not too fussed about the ILR but nice to know what I'm looking at. I was expecting that having a visa starting Jan 2010 would have made a difference.

Thanks for confirming though.

Hi manci,

Isn't madl's earliset apply date is 28 days before 10-Aug-2009. I thought period from visa stamping date to entry to UK can also be counted for qualifying period according to http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

his earliest applicatio date will be 28 days before 23 August 2014..

The 3 month concession is not going to come into play because his extended leave is unlikely to expire before then.

See Q4 and Q5 in the Sticky:

[color=blue]I think this concession is open to interpretation. Atleast some case workers applied this concession to cases where leave doesn't expire. See:
