SET(LR)

Post by rmkirfan » Mon Jul 08, 2013 10:12 pm

Many Thanks Guru..

1)My Tier 1general visa expires in Jun 2016 and eligible for 10 years LR.
Can you please suggest best way to go.

2)What is difference between FLR (LR) & SET (LR)?

3)As my wife dependent visa is until Jun 2016. Does it really require status change.

Please suggest.

Flr(lr) is to extend if you are not eligible for set(lr) due to not meeting KOLL, you will be applying for set(lr) to settle. When did your spouse get her dep leave?

Many Thanks Guru..

1)My spouse entry clearence was in Aug 2009 and recently(Jun 2013) had Tier 1 extension and valid till Jun 2016.

And also few queries..

My status From OCT 2003- 2006 Student visa
2006-2007 SEGS visa, 2007 - 2009 - student visa
2008-2011-PSW visa,2011 - 2016 Tier 1 general.
In 2007(between SEGS & student ) I was rejected on Tier 2 visa, But applied for student in time and I got it. Due to this I got 4 months gap due to HO decisions and during this time my passport is with HO while im in country.

1)Does this rejection effect my application?
2)I have my 3 years student letters and P60s for the past 7 years .
please advice best documents required For example: Bank statements, Bank letters, Tenancy agreements, employment letters etc..

Cheers for your kind support.

When you were rejected, had your previous visa expired? If so when and how many days between being rejected and reapplying? Is your partner on a dependent visa or not?

Yes,my current (SEGS)visa was expired when rejected Tier2 rejected,But my passoprt was still with HO. Reapplied to student in 20 days.

SEGS Expiry 17 Dec 2007,But I applied for Tier 2 approval in Mid Nov 2007. As my visa was expiring on 17 DEC 2007, I had to send my passport on 17 dec before approval.Later next week Igot rejection, while my passport was still in Tier2 dept.As I knew my passport gonna be back with refusal.During that time I applied for student visa with out passport in first week of Jan 2008.Then my passport was rejectedd back with stamp dated 17 Feb 2008 from Tier2.And later next week I got a call from Student visa to submit passport, which is submitted and granted from 4 april 2008 to april 2010

My spouse joined me in Aug 2010.I was single at that time.

Sorry for for long story,It was my critical few months.
Hope this doesnt effect my 10 years LR?
Is there any option to keep my spouse in Tier 1 dependent until expiry (Jun2016),If I apply my ILR in OCT 2013.

Please advice, Your valuable advices much appreciated.

Your wife should be able to apply for settlement set(m) when/if you are granted long residence ilr. Though, she may need to switch to flr(m) first then immediately set(m).

You should be ok on the PBS dep visa until such times that you either intend to settle or the visa will expire. You should be able to travel. You may not need to switch to flr(m) and may be able to apply straight for set(m). Though, some people have been made to apply for flr(m) first, either way upon your success, settlement should be possible.
