Council tax for Tier-4 dependants

Post by nishad.zaman » Fri Jul 05, 2013 9:34 pm

Hi, I have recently got visa under tier-4 dependants and I am disabled and registered in gp as disabled, and I do not do any job, as I am living with my wife [student], so the owner of the house told me that council may ask me to pay council tax, as my wife does not need to pay council tax for her student status, So do I have to pay council tax?

Thanking in advance.

I think council cannot ask you for council tax. You also fall in students category as you got Tier-4 dependent visa and after all, Tier-4 is a student category. Universities/Colleges usually issue a letter to council to waive the council tax for their students.

Who is the main Tenant in rental agreement? Plus, the size or house and number of rooms also affect council tax. If you are living in a big house, you need to prove that everyone living in house is student.

Thanks a lot for your reply. As we live in a flat, 2 bed rooms, we pay rent to the owner, all other members of the house are students except me. I was a student and completed my study last year and switched my status as dependant of my wife [student].

Council did not write to me yet, but primarily the flat is in contract of other three members included my wife and home owner already provided the council tax papers of them [3 members students] and they are exempt but home owner guess that as they all have provided papars as students except me, so council may ask me for council tax. This is all about. Thanking in advance.

Council will never write you coz how they will know your name if your name is not included in rental agreement? Plus 3 student letters are enough to get this property exempted from council tax.

I remeber when I was student and living in a 6 bedroom house with 9 other members. We also made rental agreement on 3 students name and submit 3 letters accordingly. We lived there for about 6 years and every year we submit rental agreement and 3 student letters to get council tax exemption. Council never ask anything else except rental agreement and 3 letters in those 6 years.

Just because you fail to inform the council that non-exempt people are present does not make it right. If there are any non-exempt people in the property who reside there then, the house should not receive a 100% exemption. The tricky bit is usually working out who is liable/who will pay.
