Hi everyone

I need to apologise if this has been answered somewhere in this forum, I ve been searching and cant find an answer to this......

if a spouse is applying for extension cos not qualified for indefinite leave to remain, would he have to go thru tier 1 dependant again ( as he currently is) or cos the spouse now holds indefinite had to go thru flr(m) form?

I ask this cos went thru the guidance for both forms and seems he could use any however the fees are different flr is higher and with the tier 1 dependant ......they seem to be wanting maintenance requirement from applicant even as a dependant..........

am confused not sure which will be best.....I remember somewhere on this forum people had advised they've been asked to change their application form for the correct one at some PEOs so not sure which is which.

any help will be greatly appreciated

Depends, if the spouse qualified as a PBS applicant (5 years) then the dependent would extend as a PBS dep. If the spouse qualified as a Long Resident applicant (10 years) then the dependent would apply for an extension on flr(m).

I guess you will be covered by paragraph 319C. which implies you will have to apply as a Tier 1 dependent and hope to be granted 3 years.
