ILR - WP + Tier1(G) + Tier1(Extn)

Hi All,

This might have been a repeated question most of the times but would really appreciate your help for my case.

WP
- Entered UK in mid-Aug 2008
- No P60 for 2008/2009

Tier 1 (G)
- Changed to Tier 1(G) in Mar 2009
- P60s available from 2009

Tier 1 (G) Extn
- Extended Tier 1(G) in Mar 2012 (valid till Mar2014)

Eligible for ILR from 14 July 2013.

The SET(O) form is a bit confusing to me as I am not sure if last 12 months details are sufficient here or 5 years details on P60 etc.

I dont want to waste ~1000GBP for just saying a P60 is not needed and taking up my case. Also feel 200GBP would be a waste for just checking.

Is the employment history really needed ? There is no ask for 5 year proofs in the the ILR but lot of people are providing the same.

I dont to provide any additional documents going out to HMRC but at the same time want to avoid any shortage.

Appreciate your help and any other guidance which you feel is needed considering my case.

There is no need of P60 but it is always better to carry them. Why don't you have P60 for first year?

P60s are only given to employees if they work through the April month of the tax year. I guess the OP didn't work throught that month of that year.

Thank you for replying.

Why no P60 for first year?.... As I was deputed here by my company on a per diem basis and claims of bills so nothing was official in records. The company was acquired in 2009, but I am covered due to switching on Tier 1 for that year. My T1 application was more based on India salary.

It's the initial 8 months (Aug08 to Mar09) which I can't prove the financial activity. The HMRC letter won't help as there won't be any record I believe.( I am not sure but want to keep this as the last option).

If you were paid in India, it is fine. It is as per rules and guidelines of HMRC. Most of the companies can do this for first year of stay in the UK.

UK-INDIA have double taxation treaty hence as long as you paid taxes in India, it should be OK. Make sure your WP is qualifying WP meaning there is not written "multiple entry" on top left of the corner.

Also in such cases, case workers normally asks for original WP document hence it is good to carry it with you.

In addition to above one of friend was in same situation as you where he had latest 4 P60s and first year tax was paid in India. His application is successful.

so for the first year, i will carry the following :

1) WP Document
2) T1 Approval doc from UKBA

i wont add anything further to complicate.

I got my ILR yesterday. Thankyou all for the support.

The case worker called me and asked for my previous P60 or any reference letter showing initial employment proof. I had my P60 for 2009. She was fine with it.

No other issues if you follow the Set ( o ) form clearly and avoid too many documents.

Incase you guys are in this situation, please keep any employment letter or proof ready. The HMRC letters wouldnt have helped.

Yes. I had already provided all the HSMP approval letters. The Case worker asked for the proof for my employment. I didnt have the P60 for my HSMP duration. The one I provided was for Tier 1 period prior to the current employment.

She seemed to be pretty flexble and chose the P60 from the documents I had.

As per section 11L you should provide evidence that you are inline with immigration rules for the period prior Tier-1.
So even providing the P-60 for the period for which you where on Tier-1 not WP would not meet this requirement.

Sorry for replying late. Thought might still be useful.

For the time i was on WP, I had to show some proof that I was working for the same employer. Hence a salary slip or letter (old one received during WP) from that employer or a bonus letter etc was sufficient.

It wasnt the P60 but a proof required. Any letter from that company showing that you were in employement would do.
