FLR( M ) or or ILR

I am currently working in the UK on a Tier 2 ICT visa with the same employer since Nov 7th 2010.

My husband has recently got an ILR. We got married on Oct 18th 2010 in India and have been staying together since Nov 7th 2010 in UK.

I am planning to switch over to my husband’s dependant visa (FLR M or ILR).

Can you help me with the below queries please-

· Can I apply for the Spouse visa (FLR M) from within UK or do I need to travel to my home country for Entry clearance

· Will I be eligible for ILR now do I need to wait for another 5 years for getting the ILR./ When will I be eligible for ILR after I switch over my visa

Hello max-payne,
Yes you can switch to spouse visa using application form FLR(M) in the UK, you do not need to travel to your home country if you can provide all the necessary and required evidence of marriage and proof that both of you have been living together here in the Uk

You'll be subject to the new 5 year route to settlement as you were not a dependent. Flr(m) is correct. As you are working legally, you can use your income to meet/help meet the financial requirement.
