Problem to get another Short term Schengen within 90 days ?

Post by tebee » Tue Jul 09, 2013 7:20 pm

I'm an UK citizen exercising my treaty rights in France . My Non-EU wife still works away part of the year even though she holds a tirture du sejour here.

Now she had a new residence card to pick up, but is currently in Bangkok and the card is here. So we thought no problem, we will just get her another short term Schengen visa to come back. When she when to apply she was told she could not have another within 90 days of the last one expiring. She needed one earlier in the year to pick up the previous card.

Now this is a little embarrassing as we had already booked the flight, but surly, as the spouse of an EU they can not refuse her a visa. Under protest the supervisor agreed to accept the application, but warned that it might be refused.

I believe what we should have done is apply for a recepisse de carte du Sejour before we left, but I did not foresee it being a problem getting a new visa. The Short term visas is perfectly valid is she is returning in another month to resume work.

There is no reason why another visa cannot be granted. Every facility, on the basis of an accelerated procedure...
