Can i still appy for ILR with these absence?

Can i still appy for ILR with these absence?

visa granted tier 1- general 6/5/2009

travelled uk 1st time : 30/06/2009
travelled back home : 17/07/2009 (since no jobs at that time)
note: lived in uk for 17 days.

travelled uk 2nd time : 12/10/2009
note: 85 days absence from last leaving uk.

I am in Uk since 12/10/2009 apart from few days out for holidays
current visa expiry : 14/07/2014

my question is can i apply for ILR around 1st week of july 2014 or should i have to go for another
extension

the new rules states " If the absences are in connection with other employment outside the UK,
which demonstrates the UK employment is secondary, these are not permitted absences,
and the continuous period requirement is considered broken"

since I worked for a company which nothing to do with uk at the begin of my visa, does this means i need to apply for a 2nd extension

please help?
