Council N New Application

Hello Guys.
Pls i am asking this question on behalf of a good friend, and hope some Gurus and moderators can help him plsssssssss.

He is about to apply for ROR, meanwhile himself and her EEA
national wife were separated for just 3 months and later started livng together again, now they are divorce and in a verge of applying for ROR application, necessary documents are all complete because EEA wife agree to help him.

During the time of seperation my friend went to the council housing to seek homelessness with a lady that had a child for him, the lady has NO RECOURSE TO PUBLIC FUND IN HER PASSPORT, and he( my friend) gave them his passport but was refused housing because he still a dependant on her EEA wife, he also told them they dont live with the EEA wife anymore but still married. And was still later refused housing.

Pls do you think council Housing (Goverment Authority) are going to contact UKBA/HO about his separation with EEA wife before they settled and start living together.

He is Worried n about to submit his application for ROR.

No, I think they will have better things to do. If they were married then separated is not divorced.

Pls guys when Retained Right is Granted by HO, can non EEA apply for council housing and housing benefit,
despite being refused before and was told that the council authority dont how him anything because he was depending on his EEA wife

Thanks Amber, is a bit confusing, what they mean is Non EEA after ROR are not entitled to public fund, and if claim public fund that are listed may affect person right of residence,

Big Problem for the guy bcos he has been claiming CB, WTC, CTC, for the child ie from another woman as top up fund, but he has been working without stop,

Pls what do you think,

That should be ok as a worker one who has the right to reside is entitled to claim public funds.

Thanks Amber, just called Council Housing, they told me it will be fine if only you can prove that you are no longer a dependant on your ex wife wich is EEA, atleast a letter from HO.

Pls gurus / moderators thanks for your previous answers and for great help n advice, Pls yesterday i recieved a letter from the council housing, bcos i have been biding for 1 year, they are asking me to come with some sorts of documents, Prove of income, child benefit book,childrens birth certificate, passport or form of identification. they said they want to help me with house bcos of my new baby n the house is overcrowded

BUT
I will apply for ROR in november 29th bcos i will recieve decree absolute in november 20th. Pls I dont know if the council will accept my curent status as family member of EEA National, bcos i have not retained my right but have all the necesary docs to apply in Nov.
they have refused my friend before in homelessness application,

ME...
Applying for ROR with all necessary docs in november,
Two Children ( from another woman nt the EEA National ),
Full Time Employed (40hrs a wk),
Claiming CB, but stop claiming CTC/WTC due to income last year ( paying back the overpayment),
Current spouse no id no right to stay in uk but some letters from the hospitals.

Pls i am going to council housing on 16th, will i be ok with my current STATUS? and my current partner no ID but all other documents available.

You are best discussing this with the council they will access whether you have the right to reside for the purpose of housing/council tax benefits not the HO.

Ok i have booked an appointment with the citizen advice bureau on monday, they will help as well,

yes i am nt discussing any of these with the HO, just bothering in the housing aspect. bcos the same council refuse my friend homelessness app last year,

Just kinda worried if they ll help bcos of the kids and also i am nt subject to immigration control.
