Student loan

Hi guys

I applied to go to uni two years ago but could not go as my Immigration stuff was not concluded yet so i deffered my yr to 2013. I managed to fight my case through the courts and won my appeal under Immigration rules(Apendix FM parent of British child) and Article 8. I was granted 2.5 on my BRP with no remarks on it(no recourse to pub funds) and work permitted. The BRP letter says that its proof of my right to stay, work or STUDY.

I then applied for NINO and Income based JSA which was granted as i am trying to find work before i go to uni. I applied for Student loan which was refused for the reasons that i am not eligible on grounds that;

1.You have not been granted refugee status in the UK, or Humanitarian Protection as a result of a failed asylum application. If you have claimed student Finance on the basis that you are the husband, wife, civil partner or child of a refugee, or someone with Humanitarian Protection, you have not satisfied the necessary requirements. This may be because you were over 18years old at the time of your parent’s asylum application to the Home Office, or because you were not part of the pre-existing family unit at the time of the asylum application to the Home Office. If you are awarded refugee status or Humanitarian Protection during the period of your course, you may become eligible for student finance. If this happens you should contact us again for further advice.

I really think that a failed asylum seeker is given leave to remain because their claim was unfonded which makes them eligible for student loan. So that technically makes people in my boat eligible too coz we all have the same leave but different routes.

I have submitted an appeal to student loan with all the evidence from my tribunal appeal and other docs, can some one shade some light on this because i am confused as Home office state that i can study.

Unfortunately it is those with settled status or those with Humanitarian Protection and some asylum cases who can claim the student loan. Since 2011 those granted DLR have not been eligible. You can request that the university shows compassion and charges you 'home fees' indeed, some do. If you have a child then some support may be available. You may have a right to study, but that doesn't not mean a right to receive student support or home fees. I assume your BRP does not state 'no recourse to public funds'?
