With a T2 ICT Long Term Staff CoS you can apply for entry clearance any time.

Hi Manci
Thanks for this useful info but I'm not able to find this information on UKBA. The other websites (workpermit and some solicitors') mentioned for Long term staff - " should have worked for at least 12 months in the overseas branch".

You are right, I overlooked the part in pankaj.gupta's post that he only joined the company in Oct 2012. What is applicable to his case is in para 32 of the T2 policy guidance:

32. Time spent in the UK as a .... Tier 2 (Intra-Company Transfer: Skills Transfer) will not count towards the 12 months’ company experience required for the Tier 2 (Intra-Company Transfer: Long Term Staff). However, if you have worked for the company overseas for 6 months (for example) before coming to the UK as a .....Tier 2 (Intra-Company Transfer: Skills Transfer), then return and work for the company overseas for a further 6 months, we will allow you to add the two 6 month periods together.

Hi Manci,
Which means that my 4 months spent in UK will not be counted for overall 12 months of experience in company.
I will be eligile after completing one year on 19 Oct 2013 + 4 months =19 Feb 2014.

Hi team,

I am also in the similar situation, please help us in finding answers to ..

1) do we have to wait those (4 months - 4 days) to apply for Long term visa

2) does UKBA considers Visa start date or Travel date from India while calculating visa eligibility

thanks
Rakesh
