10 year long reisdency ILR - Dependent Status?

Hi all,

Here's my situation

Tier1 General - issued on 29th March 2010
Tier1 Dependent - issued to spouse on Oct 2010
Spouse entry in the UK - Jan 2011

I can qualify for ILR on a 10 year long term residency basis next year.

Will my spouse also be eligible for ILR with me as a dependent? The duration as my spouse and presence in the UK will be more than 2 years but obviously not for 10 years. Can my spouse get ILR being dependent on a person eligible for 10 year ILR?

Yes she will be eligible to settle once you are settled. Come back closer to the time.

Do you mean we will have to apply separately? i.e. I should apply, get my ILR and then apply for her and my son after that?

Is there a qualifying period after my ILR for my dependents?

Sorry mate, I know its long way but need to prepare funds and everything from now.

I will be eligible in Aug-Sep. 2014.

My spouse has a valid Tier-1 dependent till April 2016.

Both of us will be eligible for ILR in 2015 if going by the normal Tier1 route. However, with the ever increasing uncertainty on Tier 1 visas , you can never be sure they change the rules or increase fees etc. I just want to get it an year before to avoid the wait when I can. I will also have to compare the expenses of both options to see which one will cost less.

Once you are settled under set(lr), your wife would be elgible to settle. It depends what the caseworker allow you to do, some people re successful on set(m) some have to swtich to flr(m) then straight to set(m), the latter would be more expensive as it involves two applications. If you waited for set(o) you could apply together and that should be cheaper still, remember that set(lr) can take a 6 months or even longer so it could be that set(o) is actually a quicker with a premium appointment (postal only for set(lr)).
