I am a hospital pharmacist. I am currently on a Tier 2 general visa which expires in sept and am on a permanent contract with the NHS. However, when I asked my HR to obtain a new CoS code, they have told me that they are unable to and that the computer programme will not allow them to do it as hospital pharmacists have been taken off the shortage occupation list (SOL).
While reading through the Tier 2 of the points based system- policy guidance, I found some evidence to say that I am able to extend my visa if I have a job that was on the SOL at the time of which my leave was granted and if I have not been granted leave to remain since and am applying for the same job from either the same or different sponser.
This is where the problem lies because before this, my job title was a clinical diploma pharmacist and I have since finished my diploma and am now a clinical pharmacist. Therefore, I have moved up a band according to the salary scheme. Does this mean that the resident labor market test now applies?
