ILR Query - When to apply?

ILR Query - When to apply?

My wife was granted her Tier1 dependent visa on September 12 2011 in India and entered UK on September 30th 2011.She then switched her visa to ILR dependent visa[FLR(M)] in Feb 2012 at Liverpool after I was granted my ILR. I was granted my ILR on Jan 7 2012, and I was on Tier 1 General[Highly Skiiled Migrant] before that.

Her Tier1 dependent visa would have expired on March 2013 because I had my Tier 1 dependent Visa only till then. But like I mentioned before, she switched to ILR dependent visa soon after I got my ILR.Her ILR dependent visa is set to expire in Feb 2014.

My question here is when can she apply for ILR?I spoke to two different people and they gave me two different answers.One said she could only apply a month before Feb 2014 .And the other said she could apply a month before Sep 30th since she entered UK as my spouse and she will complete her 2 years on Sep 30th.

I would really appreciate if some one could clear things for me.

From 28 days prior to 30 September by virtue of immigration rule 287(a)(i)(d). Using form set(m). You can use thesettlement checking service (click).

Its been a while since my last post.As suggested here and on another thread here we checked with the Manchester Settlement Checking Service to process my wife's SET(M)and they refused to process her application. When asked for the reason, they said she can only apply 28 days prior to the current visa expiry date, 23 Feb 2014. So we are planning to apply for her Settlement end of Jan.

Now I have got a question about the English language requirement that has been imposed since Oct 28th. She had submitted her IELTS Certificate ,score of 7.5, while she applied for her current visa.It was one of the requirements listed in the FLR[M].

My question here is, will she have to demonstrate a knowledge of English Language again for SET[M]? I have read here on Page 3 that "Applicants who already have an English language qualification at B1 level or above will not be required to take another one". Does this apply to my wife?

We are planning to get a Statement of Comparability from NARIC for the Masters Degree which she completed in India,just as a backup plan.She has also got a letter from the college stating the medium of instruction was in English.While filling the online form on NARIC they have asked Purpose of Enquiry and Field of Interest.We are not sure what category my wife comes under.Does anyone know?

I would really appreciate if some one would provide with some info.

If your wife's degree awarded points on the PBS calculator?

Yes sir, my wife's degree is awarded points on the PBS calculator.What do you suggest my next step should be?

Will she not be exempt from this requirement since she has already proved it when she submitted the FLR[M]?

A print out of the PBS calculator with proof the degree was taught in English should suffice the B1 requirement in addition to LIUK.

Thanks for the info, but I just read here here tier1munda saying that points based calculator is of no use for KOLL for settlement applications after calling up Croydon office at 08706067766. So I'm slightly confused.

No, rather adequate maintenance and accommodation. See - Annex F, Chapter 8, Sections 1 & 2 (click).
