Annual Leave Letter for applying ILR from Tier1(General)

Post by akshay.gavade » Wed Jul 17, 2013 11:00 am

Dear All,

I would appreciate if some one can help me with information about my query.

I’m in uk on Tier1 (General) visa. During this period I was employed and self-employed. When I was employed during that period I was on Annual leave + paternity leave for 45 days (together) outside the UK. I’ve left that company in MARCH2010. Recently when I asked my x-company HR to give me letter for annual leave she said we don’t maintain that old annual leave records and we will not be able to provide any such letter. By the way they had provided me Paternity leave letter immediately after completion of my paternity leave.

So my question is during my employed period x-employer is not providing the letter for annual leave. Is this an issue? Has any one applied or going apply in similar case?
I appreciate for any advice.

Than you.

Annual Leave Letter for applying ILR from Tier1(General)

Hi,

I'm in simmilar situation, my previous company only provided me with letter saying I'm entiled for 23 annual leave and all my annual leaves are paid.

While I was on contract (Self employed) I had 10 days upaid leave, which the umbrella company given me a letter for this.

As I have only 133 days absense in last 5 years, it seems some old post suggesting that I should be OK. I'm thinking of not ticking the box under the UK absense for Letter from employer.

How many total absenses do you have for last 5 years counting back from date of application?

if your total absences are not more than 180days/year, you will be fine. If the employer cant provide the letter, you can write a personal letter and that will do. Wont be a problem if you are below the absence threshold.
