Tier - 2 ICT Long Term Shoplifting Penalty for £80 Need help

Hi All,

I have received penalty notice by police on the spot fine for £80 under offense code DA12 Shoplifting(I did not have intention not to pay but somehow missed it while on phone talking at back home) in May -2010. Store call police and as it was my first offense police gave me notice and ask me to pay to discharge any guilty of crime.

I have successfully applied two extension for my visa under Tier - 2 ICT Long term staff and each time I mentioned penalty under good character requirement as per UKBA guide lines.

Now I am due to apply for extension on November 2013 and my office has started my process but not sure where to mention on new form as it does not have good character box and it only have civil penalty but I think it does not come under civil penalty.

If any guru can help me that would be really great as after reading new rules I am stressed out and too much worried can not think anything else except it.

Believe me this was my first and last interaction with Law and always been very good character.

First Visa : 08/02/2010 - ICT
Penalty Notice under DA12 for £80: 26/05/2010
Visa Extentions : 31/08/2010 ICT Established Staff ( Mention penalty notice under good character requirement)
Visa Extentions : 14/01/2011 ICT Established Staff ( Mention penalty notice under good character requirement)
Visa Extension : Due in Nov -2013

I gather you were given a PCN by the police. A PCN is not an admission of guilt nor is it a conviction, it should not be relevant to the criminality threshold. F1 and F3 would be no.

DA12 falls under PND (Penalty Notice for Disorder) under s(1)(1) of Theft Act 1968, and is both notifiable and recordable.

Similar to FPN in some ways.

Since you paid the fine then and there, there is no conviction (only a penalty) so you will be fine - even though this is a recordable offence and therefore will show up in PNC.

As already mentioned above, I too don't think you need to declare it on the form.

As you mention I do-not need to mention but I do want to mention as UKBA does not hold that against me. Could you please suggest me where would be best to put in Tier-2 ICT visa extension form?

Write it on a separate piece of paper and it include it in the application if you wish.
