Can my Partner on Tier 1 PSW switch to my Tier 2 Dependent

Post by odconsultant » Wed Jul 17, 2013 4:33 pm

Hi,

I got my Tier 2 General visa in February this year which expires in January 2016. My partner is on Tier 1 Post study work visa and his visa expires in November this year.

I have been reading guidance but couldn't find anything on this situation. Can my partner apply from UK and what are the requirements. I have already got the visa so can my partner switch to becoming my dependent?

Your advice on this is greatly appreciated as we are running out of time and need show bank statement as well.

Regards

Your partner can shift to dependent visa but have to return to his home country and apply from there.

"If you are the family member of a Tier 1, 2, or 5 migrant, you can apply in the UK if you have previously held leave as the dependant of any Tier applicant. A family member who has or last had entry clearance or leave to remain as the partner of a person who had leave under another category and who has since been granted, or is, at the same time, being granted leave to remain as a relevant Points Based System migrant"
This is clear indication that if you are not in any kind of dependent categories (tier1, t2 or t4), you will not be able to apply within UK. According to this guidance, if you are not on the right platform to apply within the UK you must have to apply from outside. read the policy guidance. Everything i quoted from the guidance.

Thanks very much. This is helpful.

What are maintenance requirements if dependents are applying from outside of UK.

Will he need to show his own bank statement back home or will I be able to show the amount of £600 for the dependents? Will my partner use my UK bank statement or will he need to maintain this amount in his account back home?

Thanks

Read also Immigration Rule 319C (and in particular 319C(c)(iii)) as to other requirements to satisfy
