ILR Dependent. application Please help!!!

Hello Experts,

I need urgent advice on my situation.

My ILR was successful today. I have to check eligibility of applying ILR application for my wife. Since there are new rules in place since July 2012 and those bit confusing, would like to know if my wife still eligible to apply for ILR or which category she should apply new visa?

1. First Entry Clearance Under WP Tier 2 dependent: Feb 2008
2. WP dependent Extension in UK, Mar 2010.
3. PBS Tier 1 dependent (switch from WP dependent): May 2010.
4. Entry Clearance PBS Tier 1 Dependent: 22 Sep 2012 - Valid till Jul 2015

She was out of UK from 5th May 2012 till 22nd Sep 2012 and had no valid visa. But the entry clearance on 22nd Sep was in the same category (PBS Tier 1 dependent). Will she need to spend 5 years from 22nd Sep 2012 or her first PBS Tier 1 visa date is sufficient for applying ILR application?

She is currently in UK since Sep 2012.

I am not a pro but based on what u said that your wife had gone back to your country in 2012 as she did not have valid visa and only came back in Sep-12, Hence she will be considered as ur dependant (for the sake of settlement) since 2012 and not before. Therefore, the July, 2012 rules would apply to ur wife.
