Tier 2 extension

Post by serpent » Wed Jul 17, 2013 10:07 pm

Guys, tried searching this forum without any luck!

My girlfriend has been on a Tier 2 visa for a year now and she just got an extension of her contract for further two years. I was wondering, would it reset her "counter" of years to settlement if she applies from her own country prior to current visa expiry date?

Second question is, I am a british citizen and we have been cohabiting for nearly 4 years now, I have just realised there is a partner visa she can apply for. Would any of these 4 years or even 1 year spent on T2 visa count toward her settlement?

Any help or links to relevant posts would be greatly appreciated.

Is she on a Tier 2 general (vs ICT)? An extension would not reset her counter, but changing visa category (to family) most definitely would reset her clock (unless she is intending on applying for Indefinite Leave to Remain based on 10 years' residency).

By switching to an unmarried partner visa, she would be looking at another five years before she could apply for ILR.
