Tier 4 PSW spouse dependant

Hi there,
I came to UK as a student in 25th August 2003, I got married in 2008 and my wife came to UK as a student in 2008, I changed my student visa to T4 spouse dependant visa as my wife was student. Currently my wife is in T4 PSW and I am on T4 PSW spouse dependant visa. On 25th August 2013, I will be completing my 10 years and will be eligible to apply for my Indefinite leave to remain, however about 8 months ago my wife and I had family issue and we are separated. Since then she wrote to home office to cancel my visa as I am on her dependant visa, on the result of that action from her, I have recieved a letter from home office on 10th July 2013 stated that they are minded to curtail my visa on the basis of my wife's statement, however they have not enclosed the statement on their letter and gave me 14 days to reply if I have a statement against their proposal. I need to mention you that we have a son who is 3.5 years old and born in UK. Though we are separated but I have been paying for their the maintenance such as - house rent, utilit bills and food expenses. In this situation, what should I write back to home office and what could be the outcome if you could advise please. As I am completing my 10 years legal stay in 25th August 2013, I probably eligible to apply for ILR anytime after 25th July 2013. How to handle this case please advise. Our current visa expiry is 30 April 2014.

you came uk on 25th Auguest, 2003 and will be completing 10 years on 25th Auguest, 2013 and you have got a letter regarding curtailing your visa on 10th july 2013 to be answered in 14 days. But good thing can be for you is that you can apply ILR on long residence 28 days before of 25 August. But in the meantime you must contact UKBA too regarding how many days of your visa will be left after curtailment. I am fully sure that even if they curtail your visa then nearly the last of week of JULY you can be eligible for ILR.
