Tier 2 application refused, appealed, process to withdraw?

Tier 2 application refused, appealed, process to withdraw?

Hi,

My Tier 1 (General) Visa expired in Feb 2013. My employer offered to sponsor me for a Tier 2 (General) visa and I submitted my application prior to my other visa expiring.

In April I received a letter saying I was refused the Tier 2 Visa due to my sponsor not completing a Resident Labour Market Test. My employer advised me to appeal and are supporting me through this process. I have recently had a letter saying my appeal is set for November 2013.

This whole process has been very stressful and I've now decided that I don't want to go through with the appeal, and instead I plan to leave the UK around the end of September.

I've seen a few topics from people who have requested the return of documents and it seems to take quite a while - is it normally around the 20 business days that the UKBA suggests? Is it different for me because my application is pending an appeal hearing?

I am still working while waiting for the appeal date - if I request my documents, does that mean I have to stop working immediately or can I continue until I have received them?

I think you shoud wait bit more so you can get your Tier 2.


If you withdraw your appeal then , I guess, you will have to stop working and leave the country [Double check]

Thanks.. any idea if it really takes 20 days to get documents back? Is this the right process to request them if I'm waiting for an appeal?

I'm really sick of this whole process so I don't really want to get the visa anymore. Plus I'd be stuck working at the same company as the sponsor which I'm not keen to do after they messed this up.
