Tier 1 General category - absence question

Hi guys,

Wondering if someone can kindly help me about a question that's buzzing in my head for a very long time. I'm currently on Tier 1 general visa category (HSMP previously) and will be applying for PR (ILR) in the UK around Jan 2015, given it'll be 5 consecutive years in the UK.

In the last few years, whenever I visited India, I use to go for more than a month as my family is based there. The total number of absences so far is around 160 days in the last 4 years, so I'd like to know if I exceed 180 days absences in total in the last 5 years that aren't consecutive in an year (12 months) - would it impact my application for PR?

The current rule is 180 days per year and not in total 4 years. So you must be fine. Make sure if you are permanently employed during your days off it is better to take a letter from the office stating the absence and the type of leave (personal or business) and that you were paid during the period of leave (i.e you were within the specified leave amount under your contract of employment). This letter will prove to be helpful for you.
