Hello friends
I know that this might be asked before but I struggled to get an answer surfing through the posts.
I am on Tier 1 and had a baby born in June. Right now I have not applied for his Indian passport. I was going to but got confused with his eligibility. I am eligible to apply for ILR in November and had plans to travel to India in December. I did not get his visa done as I thought I will get his visa done with my ILR.
The question is can I apply for his ILR along with mine? I read somewhere that he will not be granted visa as he is already eligible for British passport. I was thinking about applying for his passport after my India trip, sometime next year as it will give time to sort out his PIO card as well.
Can anyone please advise his status now and what my options are ?

Was a parent settled or British when child was born? If child is not yet British, then s/he is not yet eligible for a British passport.

Neither of us were settled when the baby was born.
I must have pointed out that I have not applied for the newborn's visa yet - just about to apply his passport. My thinking was since I am applying for our ILR in November why not get his done at the same time as well.

Can I go ahead with my thinking then - that is apply for his visa on Indian passport along with my ILR?

once you obtain ILR your child is eligible for registration as a british citizen under section 1(3). you can subsequently apply for his british passport.
however if you are applying for ILR in november and then intend to travel in december then the above processes may not fit with your travel plan.
