Will my working overseas affect husband's ILR application?

Post by fulinxi » Thu Jul 25, 2013 11:34 am

HI there

I need some advice.

My husband came to the UK as my fiance and now is on a spouse visa. He is due to apply for ILR in January. His fiance and spouse visa applications both went through smoothly.

We have a UK marriage certificate, good jobs, a shared mortgage and shared bills etc., so hope that his application for ILR should be relatively straightforward.

However I have been offered the opportunity to travel for work on three occasions over the next five months, for three weeks per time. This means I would be out of the country and separated from my husband for nine weeks over five months.

Does anybody know if this is likely to cause an issue with my husband's ILR application. We know he cannot be overseas for more than a certain period and that we have to show we live together, but is my travel a serious risk?

UKBA are very vague and say the longer I am away, the more attention this will draw to his case, but that I can provide a letter from my employer showing that I was required to travel for work.

Does anybody have any similar experience they can advise on?

Thanks!!!

It won't affect your application.

Hi Casa!

Thanks for replying. Can I ask what leads you to that conclusion? Do you know of similar cases?

Thanks

Lots. Your 3 week periods away for work won't cause a problem as you're still living with your husband at the same UK address.
