Switching Tier 4 student Visa to Partner Visa FLR(M) from UK

Post by sash101 » Fri Jul 26, 2013 4:36 pm

Would really appreciate help.

I am currently on a Tier 4 student visa completing my PHD with my visa expiring in mid 2016. My wife come to UK with me as my Tier 4 dependant but was eligible for UK Citizenship under UKM (children born to British Mother before 1983). In August 2012 she was granted British Citizenship under UKM.

I now wish to apply for conversion of my Tier 4 visa into a partner visa of a UK citizen as we both intend to make UK as our home after my PHD. I have the following questions:

1- Can I switch from student visa to partner visa from within the UK using form FLR(M), without having to apply from my home country. The UKBA website shows that switching is possible from UK. Can you please confirm if I can apply from UK?

2) I receive an annual maintenance grant of £19,300 for my PHD (over and above the tuition fee) for the 3 years 2012- 2013 and 2014. I have received the allowance for 2012 (in 2012) and 2013 (Jan 2013) and for 2014 due by December 2014. Would this cover my financial requirement? I have all the evidence of payment and letters from my sponsors. My wife is a homemaker and no income currently.

Thanks!!!!!

You do not want a partner visa, you need to apply for a spouse visa.

As regards whether your funds are sufficient, please tell us .... are there any children in your household? If so, how many?

You are holding a student visa for PhD though your spouse got UK citizenship under UKM on August

2012. You should consult an immigration officer before you apply for student visa to partner visa.
