PLEAS HELP!! - ILR for Spouse

Hi All,

I am due to make an ILR application in September and have been away from the UK for less than 7 months (in all of the 5 years)

My spouse also has been away from the UK for around 7 months in the last 4 years - original entered UK under Tier 1 General - dependant visa in July 2009 (not completing 5 years when we apply for ILR)

Can she apply with me as the same time for ILR or does she need to qualify the 5 year period?

She is under the old rules, thus qualifies after 2 years not 5.

Also, does she need to be in the UK for a continous period of 2 years? She was here for 17 mths initially then away to India for around 7 mths and now here in the UK for around 21 mths. Will this cause a problem? I cannot find any specific guidance for the 2 years continous stay in the UK for dependants when applying for ILR.
