EEA Spouse of a Brithish Citizenship

HI to everybody!
I'm a little bit confused how come a EEA wife of a British Citizen has to have 5 year settle in UK and a wife outside from EEA of a Brithish Citizen has to wait only 3 Years to become brithish. If I'm wrong please correct me but I spoke even with somebody from National Checking Service.
The other question is about Life in the UK Test. My wife done the test in 2009 and I don't know if will still be OK for application in November when she will have 5 years settle in the UK. I heard that from September will be different test and the old one not OK. Please help me.

You are wrong the route to settlement is now 5 years both ways, though before July 2012, there was a 2 year route to settlement as a spouse under UK domestic legislation.

The new test is from October, the LIUK will still suffice for part, though the other part will need an English Language test or if she has a degree (comparable to a UK one) taught in English it should suffice. What is your wife's current visa?

Thank you Amber for such a prompt response. My wife is from Romania and has 'blue card' from 2010. She came in 2006 in UK with visa and gone back in 2007 in Romania (health problem). She came back in UK in 2008 and she apply for Indefinite Leave to Romania but she's been refuse because she didn't have 2 years in the UK with visa.
My question is if she can apply in November for naturalization because she will have 5 years of work in UK even first year and a half she was working on the insurance number but she didn't have a 'blue card' because she make the wrong application.
She made ICM (Institute of Credit Management) at London Metropolitan University and now she study for ACCA. Is any of this included in the second part or has to be a specific English test?

In order to be naturalised as the spouse of a British citizen your spouse will have to be settled (PR or ILR). Please see here (click) and see if your spouse was exempt for the authorisation requirement. Also, had the British spouse (you?) exercised treaty rights in another EEA Country before 2008? The time as a student would only count for exercising treaty rights if you had comprehensive sickness cover unless she was working at the same time?
