Earlist date to apply. For ILR

Post by mego_1980 » Sat Jul 27, 2013 7:04 pm

Hi,

My wife has 2 year spouse visa and i just would like to know when she would be able to apply for her ILR. She has entered uk on 4/2/2012 and her visa stamped on 24/11/2011 and valid until 24/04/2014.

She will apply using PEO service (appointment). Your help would be gratly appreciated.

Thanks for your reply.
But that means she will apply on say 06/01/2013 so if she will go for same day service on that date she would not have completed her 2 years probationary period since she entered on 4/02/2012.so , ukba will hold her application. Please correct me if i am wrong.

From ukba website. (If you were given a visa in this category but you then delayed your travel to the UK by up to 3 months, you can apply for settlement using application form SET(M) shortly before your visa expires. Provided you meet all the other requirements, we will put your application on hold until you have completed your 2-year qualifying period in the UK.)

Thanks

She can apply from 07/01/2014 if she applies earlier she will be refused, but on or after this date is fine.

Can you send me a link for this please? As i am still thinking that she will be refused if she applied on 07/01/2014 since 2 years probationary period will be completed on 04/02/2014.

You can apply one month before the 24 months are up. You do not wait till she has completed exactly 24 months, otherwise if you apply after that, teh visa will have expired.....that is why you apply one month before.

Apply anytime after 07/01/14 but not before as already been stated, you will be refused
