Morning all,
I am a spouse of Eu citizen exercising his treaty right since 2006 and I obtained my EUFAM4 exactly 5 years ago. During this period, I have never worked but my husband (EU) has been in employment. We had 2 children who are also Irish. My husband lost his job last month and my EUFAM4 will expire in August. I am about to make my PR application this week.
My question is,
Now that my EU husband is now on job seekers benefit, what implication would that have on my PR application (although he has been in employment since 2006 continuously untill last month)?
I personally think my husband's jobseeker benefit approval is as a result of his PRSI contribution to the system since 2006, but how it will affect my PR application is what is bothering me.
Please all contribution is appreciated

The answers to your question can be found in directive 2004/38/ec.

It appears that your husband has achieved PR himself given that he worked for five years. PR holders no longer require to be exercising treaty rights.

In any event, a worker does not automatically cease to be a worker in the event of involuntary employment.

Your application should be successful.

You are the mother of a child who is an Irish citizen. Your right to reside in Ireland will be renewed at least until the child is 18 years, so long as the Irish citizen child continues to reside in Ireland.

The jobseekers benefit is payable to your husband because he worked here for years. It usually is paid for 9 months only and hopefully he will have a new job before the 9 months are completed.

When jobseekers benefit stops your husband may apply for jobseekers allowance. You say that he is an EU citizen who has lived in Ireland for years, so he should hopefully pass the first condition for jobseekers allowance, which is called habitual residence condition. The next condition is called a means test - this looks at his bank details in Ireland and abroad (if any) and his ownership of property in Ireland and abroad (if any) and his income (if any). The amount of money he would get depends on how much income and property is calculated against the family. The family home in which the couple live with their children is not counted as income or asset. Property owned abroad is counted and this is a problem for some families.

Thanks all for your contributions,
The other trouble am having now is documentations.
We have live in the same address for the whole of 5 years, we had 2 kids there.
the document i have now are_
6yrs p60 for my husband,
1 tenancy agreement (both in our names)from the beginning of 2007
spouse scanty payslips.
am afraid this might not be enough documentary proof.
am not very good in record keeping so my bank statement are not complete for each year. I intend to go to the bank now to request for continuous 5yrs bank statement if possible

You have been given the best advice by the MOD, you don't need bank statement for 5 year, you only need p60 for the 5 years duration to make a PR application

Based on the information you've given, you can also apply for a certificate of naturalisation which is above anything you seek to apply at the moment.

Thanks all for your advices, I have submitted the PR applications (EU 2&3)for both myself and my EU spouse.
I will give update as soon as I get any response. I hope the EU application will be treated speedily as specified by the directive.

do any one have idea on the waiting time for EU2 applications(Eu citizen applying after 5yrs )
I know EU3 (non EU family)currently takes 6months

Hi,I need help plz,I m in Ireland from jan 2003,almost 11 years.from 2003 to 2009 I was student,in jan 2009 I got married with eu nation,after 3 and half years ,she left ireland and went to her country,but she was studying and part time working in Ireland,I m full time working,I never apply any social benefits,in short when we got divorce after 3 and half yrs,I applied my individual status and GNIB approve my application,thy dd not give me new stamp but send me letter i can live in Ireland on my individual status,I wana ask when my stamp 4 eufam will expire,
Which stamp I can apply?
Can I apply citizenship?
What is my residency status in Ireland ?
