It is end of July and I have been married for 2 months, I love my wife she is beautiful and I cant wait to see her, we speak via text,calls,facebook at the moment and soon skype

The problem is that I am in the UK, I am educated to a level 5 HND construction but due to problems with mental health I am claiming ESA AND DLA....

It has been 6 months since I have been claiming these 2 benefits but I live with family as thats how I like it...

I want to bring my wife over to UK although she is born and bred in pakistan

The information I have recieved using online resources is that if I am claiming DLA i can submit a spouse visa application although I am not earning any where near 18,600 I am exempt as far as I have knowledge off... what I have read

Fantastic Great News.... However I assure you that I am thinking of getting back into work very soon as I am sick of being unemployed and at home, I actually want a life better and more stable, so i have put forward a few job apps and I am optimistic of finding work....

Now my concern is that if I submit a application for my lovely wife to come over, the proof I need to show is about the DLA and the Employment, by the time I send the application which will be as soon as I get a job, maybe next month I will sign off ESA benefit and my bank statement will verify that I am earning a few quid a day and also DLA, therefore this will be great on paper when they review application

My wife is abit slow on english however she is reading more and currently this is helping but she does not have the english language certificate because she is not ready to take the test course.....

Can I still apply the visa for spouse even though she is has no english certificate at the moment, we both estimate that it could take 6 months for her to be ready for the test course

6 months is ample time for me to work and also claim DLA so when should I really apply for the visa spouse application....

I await your feed back please read again and dont be rude to me please I am British and I have found a beautiful partner.....

Hi Muhammed,

I would err on the side of caution, you may think you are ready for work, however, you may not be.

As you're claiming ESA, you can do what is called permitted work and still claim the benefit. This can usually be for up to 16 hours per week for up to 12 months. You can do 16 hours per week to see if you can cope ok. There is no point stopping ESA only to have to restart soon, you can discuss this with a disability advisor at the Job Centre Plus.

DLA can be claimed whilst you're working, it's an 'in work' benefit. Again, you could try the work whilst claiming DLA and see if you can cope.

It's is perhaps advantageous that you claim DLA and get your application in for the visa ASAP subject to your spouse satisfying the English requirement and assuming your marriage is valid in the UK.

If your wife has difficulty with the English language test, there is the option of moving to Ireland.

You would need to give up the DLA and find work in Ireland. If you get work in Ireland your wife can get visa for Ireland without any English language test, so long as you have payslips to show that you work in Ireland and marriage certificate to show you are married.

Then about a year later she can get visa for UK and you go back to UK. She never needs to pass English exam if you take this option.
