Hi All,

I know this is going to be very early BUT need urgent help.

I have spent 2 years from 14-06-2011 to 14-06-2013 on Tier 1 General Visa. My wife was on my dependent for the whole period. Now i have changed my visa status from Tier 1 to Tier 2 General. my visa is valid from 07-07-2013 to 06-07-2016. same goes for my dependent.

Now i will complete my 5 years to be eligible for ILR on 14-06-2016.

My wife for some family reason is willing to go to India for 6 months. I am not going because i understand that my continues 5 year period will break. I am only allowed to go out of country for only 180 days in 12months. Is this correct?

Is the same rule apply for my dependent as well. Is 5 years of continues residence period rule applied to my wife? I understand from UKBA website that my wife will be eligible for ILR if she is granted leave as a partner before 2012 and have stayed with me for 2 years. Is this correct? UKBA website also says that from April, 2016 there will be a change for ILR rules so does that mean i will be under new rule when i apply for my ILR in 2016?

Please suggest if my wife goes to India for 6 months now. will it create a problem in 2016 fro my wife to get ILR.

1. yes
2. No, dependents can be out for longer with valid reason, like child birth, illness, etc.
3. rules might change but information is correct as it stands today.
