It's likely that a caution would be recorded on your criminal record (check the PNC by completing a SAR at your local police station) and thus be a general grounds for refusal for 24 months.

Thank you for your reply. Yes it is now recorded on my criminal record. My present tier 2 visa expires in December 2014 and would need an extension for atleast 8 months prior to applying for ILR in 2015. Will I be able to get a extension on my tier 2 visa ?? Does the Police caution affect my tier 2 extension. Given I don't have any problems from here on. I should say this has given me and my partner a clear warning and a message.

You should be able to extend if you meet the criteria for an extension. Though, there was a forum member who claimed to have been successful with a Police Caution which had not 'lapsed'. You could do a PEO and take both set(o) (I assume you're a PBS applicant) and the extension forms completed and see what the caseworker says.

What is a PEO ? You mentioned a forum member was sucessful - where they sucessful in applying for visa extension or their ILR ? My caution was issued only a few weeks ago and I don't think it ever lapses it will stay on record forever and will become less important as time goes by thats what I was told.

I am on tier to 2 visa employer sponsered with certifcate of sponsorship and PBS. So you would suggest I do the premium service for the extension and speak to the caseworker directly when am applying for extension.

Would there be any use if I use immigration solicitors to apply for ILR now. As it was a one off incident and we were not aware of what we were doing when we dialled 999. Not sure thats why I am asking you again. I did read the document about general grounds for refusal for non custodial sentences - just wondering if a immigration solictor would be of any use for us now.

Thank you once again for your advice. It was been of immense help in making up my mind as to what we are going to do.

A PEO appointment is a premium service (click) which can give a same day decisions if eligible and you can see a caseworker in most locations (unsure about Croydon and Solihull).

The other forum member was successful for ILR on set(o), the caution was given in the preceding two year period.

The caution is 'lapsed' for general grounds after 24 months for immigration applications and 3 years for citizenship.

The caution should be 'filtered' from all DBS (old CRB) certificates after 6 years.

Thank you very much for your advice. My visa expires December 2014 so was just thinking if I can make the appointment for it as soon as possible, as the last time I sought appointments for premium service I was unable to find one even in 3 months time.

The appointment process has changed due to fees therefore, you should be able to get one.

when is the earliest I can apply for extension of my tier 2, is it 3 months before visa expiry.
