Traffic Offence

Post by leek403 » Tue Jul 30, 2013 10:47 pm

Hi

I am a long time reader and I feel bad for only taking information from the website and not contributing - but then again, I suppose my contribution would have been rubbish anyways :p

I would be extremely grateful if I could get your views on the following:

[oops - dont want my personal history on google]

Many thanks

Lee

Disclose in Good Faith

Post by VR » Wed Jul 31, 2013 1:56 pm

Friend,

Two wrongs dont make a Right. Disclose in good faith and hope for the best.
Where is the guarantee that you will not be found out if you do not disclose?

Good Luck

Well what was the question, the removal has now rendered the thread useless.

I assume the offence was driving without due care and attention. Was the points and fine issued as a FPN by the police or by the court, if by the court, when?

It was driving without due care and attention and it was given by court

You'll have to declare it, it wouldn't affect your application per se. However, if the caseworker is sharp, they might see that's its not been declared previously and raise a flag. It's unlikely, however, the potential, perhaps extreme consequences, could be revocation of your ILR. I suspect your application would succeed.

exactly my thought... 50/50 really in this case. Would you personally recommend I get a lawyer?

I don't see how one would help. It's all down to how scrupulous the caseworker is.
