Housing Benefit!

Hi there,

I would like to ask about Housing Benefit. Can a person on ILR claim housing benefit? as it says only british citizen can claim it when i checked it on housing benefit calculator on gov.uk?

You can claim if you have been granted ILR, just tick British for the calculator. If you have a partner, is s(he) subject to immigration control?

hi,
i got same situation having ILR and partner subject to immigration control,
Can i claim Housing benefits? as i my partner is not working and my earnings are approx 800 a months.

You can certainly claim the benefit under your name (you as a first applicant) and with your bank details for the payment to come through :)

I am just wondering that when my dependent will apply ILR after one year or so than these type of benefits (which i am claiming ) will hurdle in her (dependent ) ILR application in near future, is that right?

Nop as you will be the one claiming benefits and you have the right to do so. All she needs to show at that time is probably few payslips stating that she is earning what is sufficent for her. Best thing to do is to take a legal advice few months before her application for ILR

That is not the correct advice (above) as it fails to consider an amount being given to the person who is subject to immigration control.

What is the nationality of the person who is subject to immigration control and do you have children?

me and my wife on ILR and kids got British Passport, i will be dealing with Hounslow council so is there any chance to claim Housing Benefit? I am registered with council housing association and its waiting time is 6 years?

Yes you can claim without an issue as you're both settled. Whether you actually get anything will e subject to your income and capital and the LHA rates. Go to entitled to and run a calculation, tick you're British.

Child benefit should be in your name, tax credits in joint names (I assume your spouse is here with you). Regarding Housing and Council Tax benefit, you should ensure that the applications are in joint names, however, the applicable amount should not be a couple rate (rather a single/lone parent rate) as your spouse is subject to immigration control. When you get the benefit statement check it to make sure the applicable amount is not an amount.... Because you're a couple. If you ensure this, you shoud be ok.

Dear Amber

I would like to ask for your help please, basically im a British citizen and my wife who joint me recently is subjected to immigration control( spouse visa) and she has NO access to public fund, i have two children they are British as well. last week i applied for housing benefit and today i received a letter from you the council asking me if i wish to continue my application as my wife might be breaching her visa, i was the main applicant and i put her details there as she living with me, the benefit should go to my account and it same flat i been live for the past one and half year.

would it be possible to help me with that, is my wife breaching her visa? and
what should i write to the council please

im really desperate and i dont have any idea i really need your help
