Switching from Tier 2 ICT long term to Tier 2 General

Hi,

I am bit confused around switching from Tier 2 ICT to Tier 2 General. I hope someone in this forum clears my doubts.

I got Tier 2 ICT long term visa for 2 years in Feb 2011, but due to different project requirement I was sent to Canada. After I finished my assignment, I came to UK in Oct 2012. My company has applied for Tier 2 ICT extension for 2 years and now I have Tier 2 ICT till March 2015.

My queries:
a) Am I eligible to switch to Tier 2 General ?
b) What is the maximum number of Years I can get Tier 2 General Visa ?
c) Is further extension allowed for that Tier 2 General Visa ?
d) Am I in any case eligible for ILR ? If yes, how long should I be in UK to apply for ILR ?

My mind is starting to swirl with how many people have asked a nearly identical question!

Have you looked at the sticky about switching from Tier 2 ICT to T2G??

In your case, you would need to apply for entry clearance as a Tier 2 General, sponsored by a new employer. However, you would need to serve a 12 month 'cooling-off' period outside the UK before you would be elligible to switch.

After switching you T2G, you would need to meet the requirements for ILR after 5-6 years. You would not be allowed more than 6 years on T2G.

You can continue to extend your T2ICT.

Firstly thanks for your reply and sorry for the inconvinence.

I am a bit confused about the cooling off period, as I was in UK with Tier 2 ICT Established staff visa issue before April 6 2011. I suppose that was the reason, I was eligible for Tier 2 ICT extension within UK for 2 years. If not, I would have served cooling period before my Tier 2 ICT got extended.

I am really sorry for bothering, as I am confused with more information available at many places.

I saw the below statement in UKBA Tier 2 - Guidance - July 2013

Switching to Tier 2
15. You can apply from inside the UK if you have, or were last granted, leave in one of the
categories listed in the table below:

Tier 2 (Intra-Company Transfer: Established Staff) if you
are applying to change sponsor1;

The above answers assume that you had T2 ICT leave:
initially Feb 11 - Feb 13 and during this period you spent some time working for your employer in Canada
extension Feb 13 - March 15
