Got ILR for my Wife - Glasgow PEO

Post by mrgsingh » Sat Aug 03, 2013 9:56 pm

Hi All

Just want to say thank you to all of you for your help. Just a little background--I received my ILR on the basis of 10 yrs long residency and my wife had been staying with me for last 7 yrs. She was granted FLR (M) at the same time of my ILR few days back. I wan't sure when should I be able to apply for my wife's ILR so I spoke to solicitor however he advised me that she has to be here for 2 years on FLR (M) before she could apply. After reading this forum, I was confident that my wife will get ILR now at this stage.

I booked a PEO appointment and prepared my documents along with a covering letter. I mentioned that my wife was granted Tier 1 dependent visa on and latter FLR (M) on ..... . I was advised that I am eligible to apply for my wife’s indefinite leave to remain as Paragraph 287 allows such dependants to count time spent as a PBS dependant and also time as the partner of a person who is settled here towards the necessary two year period for ILR.

After reading my covering letter, he advised that I am eligible to apply for her ILR. I was asked few questions to confirm we had been staying together for last two years however there was no problem.

I was called in an hour and given the passport back.

Thank you once again and best of luck with you...

The use of 287(a)(I)(d) is expected to change soon where spouses' settled as long residents. I'm glad you had no problems.

Nothing at the moment, but if they change the rules as intended, it would mean that pbs deps not on a route to settlement, would not be able to make use of transitional protection under Part 8 and thus would not be able to amalgamate pbs dep and FLR(M) time.
