What rules apply if applying for SET (M) after FLR (M)?

Post by Elena12 » Sun Aug 04, 2013 8:06 pm

My husband and I were married in 2011 and I was granted FLR (M) in the same year. Now that I'm approaching the end of the 2 year probationary period, I'm confused as to which rules apply for SET (M), especially under the maintenance section.

My husband and I are still in our early 20's and still have plans to attend further education. So in the meanwhile I've been working full-time in a sales job, but under the new rules, my estimated salary is less than the 18,000 pounds. My husband was in college last year, but decided to go back to work. Unfortunately a couple months later, he lost his job and has been looking for work since then. So we've been relying my my wages along and the support from my family back home. Would the support I receive from my family be okay to show under the maintenance section? Reading the ANNEX pdf on the UKBA page states that 3rd party support doesn't apply. I don't know if that's something that changed when the new rules came into place. Reading the information in this section, I know that my application would get delayed until the decision is made on High Court case. I'm just unsure about all of this due to the new changes and the UKBA aren't really clear about all of this.

Third party support was acceptable under the old rules. I believe that this is still applicable to you, under the transitional provisions.

As you are under the old rules, your salary should suffice. For a couple with no children, you should expect to show Net income per week of £112.55 after deducting rent/mortgage.
